Algemene voorwaarden Terms and Conditions

2. Diensten

Fensterstack biedt persoonlijke coachingdiensten aan op het gebied van interviewvoorbereiding, loopbaannarratieftraining en salarisonderhandeling. Sessies vinden zowel online als in-person plaats vanuit Nijmegen, Nederland.

Coaching is een persoonlijke dienst. Resultaten zijn afhankelijk van de inzet, omstandigheden en doelen van de individuele cliënt. Wij garanderen geen specifieke sollicitatieresultaten.

3. Totstandkoming van de overeenkomst

Een overeenkomst komt tot stand op het moment dat wij uw boeking schriftelijk bevestigen per e-mail. De toepasselijkheid van eventuele inkoop- of andere voorwaarden van de cliënt wordt uitdrukkelijk van de hand gewezen.

4. Tarieven en betaling

Tarieven worden voorafgaand aan de eerste sessie overeengekomen en schriftelijk bevestigd. Betaling dient te geschieden binnen 14 dagen na factuurdatum. Bij te late betaling is de wettelijke handelsrente verschuldigd conform artikel 6:119a BW.

Prijzen worden opgegeven inclusief of exclusief BTW, zoals vermeld op de factuur.

5. Annulering en restitutie

Door de cliënt:

  • Annulering meer dan 48 uur voor de sessie: volledige terugbetaling of gratis verzetten.
  • Annulering binnen 48 uur: 50% van de sessiekosten wordt in rekening gebracht.
  • No-show (niet verschijnen zonder bericht): het volledige sessiebedrag is verschuldigd.

Door Fensterstack:
Bij annulering door ons ontvangt u een volledige terugbetaling of de mogelijkheid om kosteloos te verzetten, naar uw keuze.

6. Intellectueel eigendom

Alle materialen, werkbladen, methodes en content die door Fensterstack worden aangeboden — zowel tijdens sessies als via de website — zijn het intellectueel eigendom van Fensterstack. U mag deze uitsluitend voor persoonlijk gebruik aanwenden. Verspreiding, reproductie of commercieel gebruik zonder schriftelijke toestemming is niet toegestaan.

7. Aansprakelijkheid

Fensterstack is niet aansprakelijk voor directe of indirecte schade die voortvloeit uit het gebruik van onze diensten, tenzij er sprake is van opzet of grove nalatigheid. De aansprakelijkheid is in ieder geval beperkt tot het bedrag dat voor de betreffende sessie(s) is betaald.

Resultaten van coachingtrajecten zijn niet gegarandeerd en afhankelijk van persoonlijke omstandigheden en inzet. Dit doet niets af aan uw wettelijke rechten als consument.

8. Toepasselijk recht en geschillenbeslechting

Op deze overeenkomst is uitsluitend Nederlands recht van toepassing. Geschillen worden bij voorkeur in overleg opgelost. Indien dit niet lukt, is de bevoegde rechter te Nijmegen (rechtbank Zeeland-West-Brabant) bij uitsluiting bevoegd, tenzij dwingend recht anders bepaalt.

Als consument kunt u ook gebruikmaken van het Europese ODR-platform voor online geschillenbeslechting: ec.europa.eu/consumers/odr.

9. Gegevensbescherming

Fensterstack verwerkt persoonsgegevens conform de AVG. Zie ons privacybeleid voor meer informatie.

10. Wijzigingen

Wij behouden het recht deze voorwaarden te wijzigen. De meest actuele versie is altijd beschikbaar op onze website. Bestaande overeenkomsten worden niet met terugwerkende kracht gewijzigd.

2. Services

Fensterstack provides personal coaching services in the areas of interview preparation, career narrative training, and salary negotiation. Sessions take place online and in-person from Nijmegen, Netherlands.

Coaching is a personal service. Results depend on the individual client's effort, circumstances, and goals. We do not guarantee specific interview or employment outcomes.

3. Contract formation

A contract is formed when we confirm your booking in writing by email. The applicability of any purchase or other terms of the client is expressly rejected.

4. Pricing and payment

Rates are agreed prior to the first session and confirmed in writing. Payment is due within 14 days of the invoice date. Late payment will incur statutory commercial interest under Article 6:119a of the Dutch Civil Code.

5. Cancellation and refunds

By the client:

  • Cancellation more than 48 hours before the session: full refund or free rescheduling.
  • Cancellation within 48 hours: 50% of the session cost will be charged.
  • No-show (no contact): the full session amount is due.

By Fensterstack:
If we cancel, you receive a full refund or free rescheduling at your choice.

6. Intellectual property

All materials, worksheets, methods, and content provided by Fensterstack — during sessions and via the website — are the intellectual property of Fensterstack. You may use them for personal purposes only. Distribution, reproduction, or commercial use without written consent is not permitted.

7. Liability

Fensterstack is not liable for direct or indirect damages arising from the use of our services, unless there is intent or gross negligence on our part. Liability is in any case limited to the amount paid for the session(s) in question.

Coaching outcomes are not guaranteed and depend on personal circumstances and effort. This does not affect your statutory rights as a consumer.

8. Governing law and dispute resolution

Dutch law applies exclusively to these terms. Disputes are preferably resolved by mutual agreement. If that fails, the competent court in Nijmegen (Rechtbank Zeeland-West-Brabant) has exclusive jurisdiction, unless mandatory law provides otherwise.

9. Data protection

Fensterstack processes personal data in accordance with GDPR. See our privacy policy for details.

10. Amendments

We reserve the right to amend these terms. The most current version is always available on our website. Existing agreements are not amended retroactively.
